1. Agreement to terms
These Terms of Service ("Terms") are a contract between you and Casa Nui("Casa Nui," "we," "us") governing access to our website, marketplace, design studio, collaboration tools, and related services (collectively, the "Platform").
By registering, browsing, requesting a quote, or placing an order, you confirm that you have read and agree to these Terms and our Privacy Policy. If you do not agree, do not use the Platform.
2. Eligibility
You must be at least 18 years old and capable of entering a binding contract under applicable law. Designers must accurately represent their skills, credentials, and ability to fulfill commissions they accept.
3. The Platform
Casa Nui is a technology marketplace that connects clients seeking bespoke South Asian fashion with independent designers and artisans. We facilitate discovery, quoting, collaboration, and checkout, but we are not the manufacturer or seller of designer-made goods unless explicitly stated on a specific listing. Designers are independent service providers, not employees or agents of Casa Nui.
We may modify, suspend, or discontinue features at any time. Beta or admin tools may be available only to authorized personnel.
4. Accounts and security
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us promptly at hello@casanuistudio.com if you suspect unauthorized access.
Designer accounts may require approval before studio access. We may refuse, suspend, or terminate accounts that violate these Terms or pose risk to users or the Platform.
5. Quotes, orders, and payments
- Quotes and proposals exchanged on the Platform are offers from designers subject to acceptance by the client and any stated conditions (lead time, materials, revisions).
- Prices, taxes, shipping, and customization details are shown at checkout or in the accepted quote. You agree to pay all amounts due for orders you confirm.
- Production timelines are estimates. Delays may occur due to fittings, fabric sourcing, or force majeure events.
- Cancellation, refund, and revision policies may vary by order stage and designer terms communicated in the quote. Disputes should first be raised through Platform messaging and support.
6. In-platform communications
Collaboration sessions, chat, and quote threads on Casa Nui are provided to facilitate your commission. Messages sent through the Platform are not private from Casa Nui. We may access, store, and review communications for customer support, dispute resolution, fraud prevention, quality assurance, and legal compliance, as described in our Privacy Policy.
You agree not to use the Platform to share unlawful content, harass others, or attempt to circumvent fees or safety measures by moving transactions entirely off-platform before an order is complete, where our policies require on-platform checkout.
7. Your content
You retain ownership of content you upload (photos, briefs, messages, listings). You grant Casa Nui a non-exclusive, worldwide, royalty-free license to host, display, reproduce, and use that content solely to operate and promote the Platform (for example, showing listing images in search results), unless you and we agree otherwise in writing.
You represent that you have the rights to content you submit and that it does not infringe third-party intellectual property or privacy rights.
8. Acceptable use
You agree not to:
- Violate any applicable law or regulation in India, the United States, or your jurisdiction;
- Post false, misleading, or defamatory information;
- Impersonate another person or misrepresent affiliation with Casa Nui;
- Interfere with Platform security or scrape data without permission;
- Use the Platform for spam, malware, or unauthorized commercial solicitation;
- Discriminate against or harm other users.
9. Casa Nui intellectual property
The Casa Nui name, logo, website design, software, and other Platform materials are owned by Casa Nui or its licensors. You may not copy, modify, or reverse engineer our services except as permitted by law.
10. Disclaimers
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, CASA NUI DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not guarantee uninterrupted or error-free service. We are not responsible for the quality, legality, or delivery of goods and services provided by independent designers, though we may assist with dispute support.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CASA NUI AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE PLATFORM.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE PLATFORM WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO CASA NUI FOR THE RELEVANT ORDER IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (USD $100) OR THE INDIAN RUPEE EQUIVALENT, WHICHEVER APPLIES TO YOUR TRANSACTION CURRENCY.
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.
12. Indemnification
You agree to indemnify and hold harmless Casa Nui from claims, damages, and expenses (including reasonable legal fees) arising from your use of the Platform, your content, your breach of these Terms, or your violation of any law or third-party rights.
13. Suspension and termination
We may suspend or terminate your access at any time for violation of these Terms, risk to other users, or legal requirements. You may close your account by contacting support. Provisions that by nature should survive termination (including Sections 6–12 and 15–16) will survive.
14. India — governing law and disputes
If you are domiciled or ordinarily resident in India, these Terms are governed by the laws of India. Subject to applicable consumer protection laws, courts at Bengaluru, Karnataka shall have exclusive jurisdiction over disputes that cannot be resolved through good-faith support escalation.
Nothing in these Terms limits your rights under the Consumer Protection Act, 2019 or other mandatory Indian consumer laws where applicable.
15. United States — governing law and disputes
If you are domiciled or ordinarily resident in the United States, these Terms are governed by the laws of the State of Delaware, excluding conflict-of-law rules, except where U.S. federal law applies or your state of residence mandates otherwise for consumer contracts.
Disputes arising under these Terms will first be addressed through support at hello@casanuistudio.com. If unresolved, disputes may be brought in state or federal courts located in Delaware or your state of residence, as permitted by law.
California users: You may have the right under California Civil Code § 1789.3 to contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs. Privacy rights are described in our Privacy Policy.
16. Changes to these Terms
We may update these Terms from time to time. The revised version will be posted on this page with an updated date. Material changes may be notified by email or in-product notice. Continued use after the effective date constitutes acceptance where permitted by law.
